Data API Terms of Service

These Data API Terms of Service (the "API Terms") govern your access to and use of the PermitIntel Data API, including all endpoints, API keys, data feeds, exports, and accompanying documentation (collectively, the "API" and the data it returns, the "Data"). The API is operated by Contract Advantage LLC, a Florida limited liability company ("we," "us," or "our"). The entity, organization, or individual that registers for an API key or accepts these API Terms is the "Customer" or "you."

These API Terms are a binding agreement. They supplement, and where they conflict they control over, our general Terms of Service with respect to your use of the API. By registering for an API key, clicking to accept, or accessing the API in any manner, you agree to these API Terms. If you do not agree, do not access or use the API. If you accept on behalf of an organization, you represent that you are authorized to bind that organization.

1. Definitions

  • "Data" means any contractor records, license information, permit records, activity rollups, contact information, scores, and other content returned by, or made available through, the API.
  • "Source Records" means the underlying public records from which portions of the Data are derived, including records published by the Florida Department of Business and Professional Regulation ("DBPR") and by Florida state, county, and municipal permitting authorities.
  • "Contractor" means any licensed professional, firm, or other person described in the Data.
  • "Output" means analyses, reports, or work product you create internally that incorporate or are derived from the Data, but that do not republish the Data in substantially its raw or bulk form.

2. License Grant

Subject to your continued compliance with these API Terms and payment of all applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license, during the term of your subscription, to access the API and to use the Data solely for your own internal business purposes.

This license is personal to you and to the seats or organization registered on your account. It confers no ownership interest in the API or the Data, and all rights not expressly granted are reserved.

3. Restrictions and Prohibited Uses

You shall not, and shall not permit any third party to:

  • Resell, sublicense, lease, rent, transfer, distribute, publish, broadcast, or otherwise make the Data available to any third party in raw or bulk form, or as a standalone dataset, feed, lookup tool, or database, whether or not for a fee;
  • Embed, display, or otherwise incorporate the Data or any Output into any product, service, application, or website made available to your customers or to any other third party. Embedded, OEM, and redistribution rights are granted only under a separate written commercial agreement with us;
  • Build, train, or improve any product, dataset, or service that competes with the API or with PermitIntel, including any database or directory that reproduces a material portion of the Data;
  • Share, publish, or expose your API key, or permit access by anyone outside the seats or organization registered on your account;
  • Circumvent, disable, or exceed any rate limit, quota, authentication, or other technical or usage restriction, or access the API by any means other than the documented interfaces;
  • Reverse engineer, decompile, or attempt to derive the source code, structure, or non-public methods of the API, or remove or alter any proprietary notice;
  • Use the Data, or any dataset derived from the Data, to train, fine-tune, ground, or otherwise develop any machine-learning or artificial-intelligence model, or any dataset, model, or data product based on or trained on the Data, except as expressly authorized in a separate written agreement with us;
  • Access or use the API or the Data for the purpose of competing with us, or of gathering information for a competitor or potential competitor of PermitIntel, including benchmarking, feature analysis, or evaluation of the API or the Data in connection with a competing product or service;
  • Use the Data in any manner prohibited by Section 4 (FCRA and Permissible Use), Section 5 (Contractor Protection), Section 6 (Outreach Compliance), or Section 7 (Privacy and Contact Data), or for any unlawful purpose.

You may create and use Output internally, and may disclose individual records to the specific data subject or as required by law, provided you do not thereby distribute the Data in bulk or as a competing dataset.

If your use case requires embedding the Data in a customer-facing product, redistribution, or bulk delivery, contact us at records@permitintel.ai to discuss a commercial license. Availability of embedded and redistribution rights varies by dataset and market.

4. Not a Consumer Report; FCRA and Permissible-Use Limitations

We are not a consumer reporting agency, and the Data is not a "consumer report" or "investigative consumer report" as those terms are defined in the federal Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"), or under any comparable state law. The Data has not been collected or assembled, in whole or in part, for the purpose of furnishing consumer reports.

You shall not use, and shall not permit any third party to use, any Data, in whole or in part, in connection with any of the following:

  • determining an individual's eligibility for credit to be used primarily for personal, family, or household purposes;
  • determining an individual's eligibility for personal or household insurance;
  • employment, or vetting of an individual that functions as employment or contractor-engagement screening;
  • tenant, housing, or rental eligibility;
  • any background screening of an individual;
  • taking any "adverse action" against an individual within the meaning of the FCRA; or
  • any other use that would cause the Data to be a "consumer report," or cause us to be a "consumer reporting agency," under the FCRA or any comparable state or local law.

Many Contractors operate as sole proprietors or personally guarantee their business obligations. Information about a sole proprietor, individual licensee, or personal guarantor can constitute information about an individual. You are responsible for ensuring that any use of Data concerning such a person does not constitute a use prohibited above, and you shall treat any such use as governed by this Section.

You represent and warrant that you will not use the Data, and will not market, describe, or sell any product or service incorporating Output, as a tool for the eligibility, underwriting, risk-scoring, or adverse-action purposes described above with respect to any individual. Upon our request, you will provide a written description of your use case and promptly cooperate with reasonable inquiries regarding your compliance with this Section.

We may suspend or terminate your access immediately if we reasonably believe your use violates this Section, and you agree to indemnify us under Section 14 for any use of the Data that violates it.

5. Contractor Protection

The Data describes licensed professionals, many of whom are our customers. You shall not use the Data to:

  • make, publish, or distribute any statement about a Contractor that is false or misleading, or that presents an adverse characterization you have not independently verified with the government authority of record;
  • represent or imply that any Contractor is unlicensed, unqualified, disciplined, or non-compliant, unless you have independently verified that status directly with the applicable government authority and accurately attribute it to that source;
  • represent or imply that we, or any Contractor, endorse, sponsor, rate, or are affiliated with you or your products, or that the Data constitutes an endorsement, rating, score of merit, or assessment of any Contractor's quality, character, or fitness.

The Data reflects permit and license records and is provided as a floor, not a complete or adjudicated record. It is not a measure of any Contractor's quality, reliability, or standing. Nothing in this Section restricts your truthful republication of public records that you have independently verified and accurately attributed to their source.

6. Outreach and Marketing Compliance

If the Data includes contact information and you use it to contact any Contractor or other person, you are solely responsible for compliance with all applicable laws governing that outreach, including without limitation the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing and email laws, and applicable Do-Not-Call and consent requirements. We make no representation that any contact in the Data has consented to be contacted, and we grant you no right to contact any person in violation of law.

7. Privacy and Contact Data

Some Data constitutes personal information about identifiable individuals, including business contact details we have compiled. With respect to such information, you shall:

  • use it only for the internal business purposes permitted by these API Terms, and not for any purpose prohibited by Sections 4, 5, or 6;
  • maintain reasonable administrative, technical, and physical safeguards to protect the Data against unauthorized access, use, or disclosure;
  • comply with all privacy, data-protection, and anti-spam laws applicable to your use of the Data; and
  • promptly honor any request we forward from a Contractor or other data subject to access, correct, suppress, or delete their information, and cease using any record we identify to you as withdrawn, corrected, or subject to a removal request.

We may update, correct, suppress, or remove records at any time, and you are responsible for refreshing the Data and discontinuing use of records we flag as removed. You shall not attempt to re-identify, combine, or enrich the Data in a manner that creates a regulated consumer profile of any individual.

8. Data Source and Accuracy

Portions of the Data are derived from Source Records published by government authorities and from third-party sources. Government and third-party records may be incomplete, delayed, mis-keyed, or superseded, and our ingestion, matching, and enrichment processes may introduce additional limitations. The Data, including any permit counts, values, dates, scores, and contact details, represents a floor based on records we have ingested and is not warranted to be a complete, current, or real-time record.

You agree to independently verify any Contractor's license status directly with the DBPR at myfloridalicense.com, and to independently verify any permit or other record with the applicable authority of record, before relying on it for any decision of consequence.

9. API Keys, Rate Limits, and Security

Access to the API requires an API key issued to your account. You are responsible for all activity that occurs under your API key and for keeping it confidential. You must notify us promptly at info@permitintel.ai if you believe your key has been compromised.

The API is subject to rate limits, quotas, and other technical restrictions that vary by plan and that we may adjust. We may throttle, suspend, or revoke a key that exceeds its limits, that is used in violation of these API Terms, or that we reasonably believe presents a security or abuse risk.

10. Fees, Trials, and Billing

  • Paid API subscriptions are billed in advance and auto-renew on the cycle selected at purchase until cancelled.
  • We may offer a no-cost trial. Trial access is provided as-is, may be limited in scope, rate, or duration, and may be modified or withdrawn at any time. At the end of a trial, access ends unless you start a paid subscription.
  • You may cancel at any time through your account or by emailing info@permitintel.ai. Cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable and we do not provide refunds for partial periods or unused access.
  • If your payment fails or is past due, we may suspend API access until the amounts owed are paid.
  • We may change plans, pricing, features, and limits prospectively. We will provide notice of material changes to an active paid plan before they take effect, and your continued use after the effective date constitutes acceptance.

11. Intellectual Property

As between you and us, we and our licensors own all right, title, and interest in and to the API and the Data, including our selection, matching, enrichment, scoring, compilation, and arrangement of the underlying records, and all related intellectual property. Source Records that are public records remain public records; our compilation and presentation of them is our intellectual property. No rights are granted to you except as expressly set out in these API Terms.

12. No Warranties

THE API AND THE DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, CURRENCY, OR RELIABILITY OF THE DATA.

WE DO NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT THE DATA WILL MEET YOUR REQUIREMENTS. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE API AND THE DATA.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONTRACT ADVANTAGE LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE API, THE DATA, OR THESE API TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EXCEPT FOR LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE API OR THESE API TERMS SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO US FOR API ACCESS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE LIMITATIONS IN THIS SECTION DO NOT LIMIT YOUR INDEMNIFICATION OBLIGATIONS UNDER SECTION 14, YOUR VIOLATION OF SECTIONS 3, 4, 5, OR 7, OR YOUR INFRINGEMENT OF OUR INTELLECTUAL PROPERTY.

14. Indemnification

You agree to indemnify, defend, and hold harmless Contract Advantage LLC and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your access to or use of the API or the Data; (b) your violation of these API Terms, including Sections 3, 4, 5, 6, and 7; (c) your creation, use, or distribution of any Output; or (d) your violation of any applicable law or the rights of any third party, including any Contractor.

15. Term, Suspension, and Termination

These API Terms apply for as long as you hold an API key or access the API.

We may suspend access immediately where you breach Sections 3, 4, 5, 6, or 7, where your payment is past due, or where we reasonably believe your access presents a security, legal, or abuse risk. For any other material breach, we will provide written notice and a period of ten (10) days to cure before terminating for cause. Either party may terminate a paid subscription for convenience effective at the end of the then-current billing period.

Upon termination, your license ends and you must immediately cease all use of the API and the Data, promptly delete all copies, portions, and versions of the Data in your possession or control (including from any computers, servers, storage devices, databases, or models), and, upon our request, return any copies we specify and certify your deletion in writing, except to the extent retention is required by law. Sections 1, 3 through 8, and 11 through 18 survive termination.

16. Governing Law and Dispute Resolution

These API Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or related to these API Terms or the API shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue in those courts.

If any provision of these API Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Changes to These API Terms

We may update these API Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the API after revised API Terms are posted constitutes your acceptance of the revised terms.

18. General Provisions

Feedback. If you provide us with feedback, suggestions, or ideas regarding the API or the Data ("Feedback"), you assign to us all rights in that Feedback and agree that we may use and fully exploit it in any manner we deem appropriate, without restriction or compensation. We will treat Feedback as non-confidential and non-proprietary.

Publicity. You grant us a limited, non-exclusive, royalty-free license to use your or your organization's name and logo solely to identify you as a PermitIntel customer on our website and in our marketing and sales materials. We will not use them in a manner that disparages you or implies sponsorship or partnership beyond a customer relationship. You may revoke this permission at any time by emailing info@permitintel.ai, and we will cease new uses and remove your marks from our then-current website and digital materials within thirty (30) days.

Force Majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, epidemics, war, civil unrest, labor disputes, government action, failures of upstream data sources or government record systems, and power, communications, or hosting failures.

Export and Sanctions Compliance. You represent and warrant that you are not located in, ordinarily resident in, or organized under the laws of any jurisdiction subject to a comprehensive U.S. government embargo; that you are not subject to sanctions administered by the U.S. government or the United Nations; and that you are not owned or controlled by any person subject to such sanctions. You shall comply with all applicable export control and sanctions laws in connection with your use of the API and the Data.

Assignment. You may not assign or transfer these API Terms, or any rights or obligations under them, without our prior written consent, and any attempted assignment in violation of this provision is void. We may assign these API Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.

Entire Agreement. These API Terms, together with any order, plan selection, or separate written agreement between you and us, constitute the entire agreement between the parties regarding the API and supersede all prior or contemporaneous understandings regarding its subject matter. No waiver of any provision is effective unless in writing, and a waiver on one occasion is not a waiver on any other occasion.
